Nun ist es also endlich soweit, die Cannabis Agentur hat die Einzelheiten zum neuen Vergabeverfahren veröffentlicht, nachdem das erste Vergabeverfahren für den Anbau von medizinischem Cannabis in Deutschland vom OLG Düsseldorf gestoppt wurde.

At the International Cannabis Business Conference (ICBC) in Berlin which took place in mid-April in Berlin, the focus was on medical cannabis and above all on CBD products. While in the case of medical cannabis it became clear that market access was still severely restricted by real obstacles such as a lack of awareness among patients and doctors of alternative therapies and the bottleneck in the dispensing process, the pharmacies, the legal uncertainty with regard to the admissibility of their CBD products on the German market was high among many companies present. Especially when used for consumer purposes, speakers were unable to provide clear guidelines. This is reason enough to take a closer look at the legal situation.

Auf der Internation Cannabis Business Conference (ICBC) in Berlin, die Mitte April in Berlin stattfand, standen neben medizinischen Cannabis vor allem CBD-Produkte im Mittelpunkt. Während bei medizinischen Cannabis deutlich wurde, dass der Marktzugang durch tatsächliche Hindernisse wie fehlendes Bewusstsein bei Patienten und Ärzten für alternative Therapien und das Nadelöhr bei der Abgabe, die Apotheken, noch stark eingeschränkt ist, war bei vielen anwesenden Unternehmen die rechtliche Unsicherheit in Bezug auf die Zulässigkeit ihrer CBD-Produkte auf dem deutschen Markt groß. Insbesondere bei der Verwendung zu Konsumzwecken konnten auch Referenten keine klaren Leitlinien aufzeigen. Anlass genug also, sich die rechtliche Situation einmal genauer anzuschauen.

Since March 2017, medical cannabis has been legal in Germany. Previously, the law only accepted the applications of about 1,000 patients. However, as of March 2018, the number of applications to the health insurance companies, which have to bear the costs of care for patients with medical cannabis has risen to 13,000 with 60% of  requests for reimbursement being approved.
